Our Process

STEP ONE - The Initial Conference

The Estate Planning Process begins by scheduling an Initial Conference with one of our attorneys.  Before that meeting, prospective clients receive an Estate Planning Questionnaire to be completed and returned to our office prior to the meeting.  This document gives us an idea of the nature of your estate and the loved ones or charities that are important to you in your planning.

At the Initial Conference we will get to know each other.  You can teach us about you, your loved ones, your goals and desires, as well as your concerns.  In turn, we will discuss with you estate laws and the many options available to you in planning your estate.

We will proceed with your Estate Plan only when both you and we feel that we can achieve substantial results.  When we feel that we can add significant value, we will formulate the parameters of an engagement, including fees, deadlines and responsibilities.

 

STEP TWO - The Design—Creating Your Estate Plan

With your help and input, together we will design a plan that is tailored to your individual  situation. We will help you decide which individuals/institutions will assist your loved ones in the event of your death or disability.  We will work with you and your advisors to ensure that the plan will work.  At the end of the Design Meeting, we will schedule a date for the Signing of your Estate Plan documents.

 

STEP THREE - The Signing—Finalizing Your Estate Plan

When your documents are prepared and ready to be signed, we will carefully review each of the estate planning documents with you to make certain that they meet with your approval.  Once you have agreed that the documents reflect your desires, you will sign them.  We will give you and your financial advisors detailed instructions for titling the assets in the name of your living trust.  Finally, we will schedule a date for the Funding Follow-up to review your trust funding.

 

STEP FOUR - The Funding—Implementing Your Plan

In order for a living trust-centered Estate Plan to work as it is intended, your assets must be properly titled in the name of the Living Trust.  This process is called “trust funding”.  At the Funding Follow-up meeting, we review the progress toward completing the funding of your  assets.  This final step in the Estate Planning Process is scheduled between 30 and 60 days after the Signing.

 

Estate Maintenance Program

Once your Estate Plan is signed and the assets are transferred into your trust(s), it is important to periodically review your Estate Plan to ensure that it reflects your current thoughts and conforms to any changes in the law.  The Estate Maintenance Program (EMP) is designed to do this.  Annual meetings are scheduled with us to review your plan, current objectives and to ensure that the trust funding has been completed properly.
